Completion of construction, acceptance of the house and use of the house

Completion of construction work is one of the final moments on the way to moving into a building. However, it is not the definitive end of the undertaking itself, which is building a house.

The last stage is the formalities that need to be completed. Before you move into your dream home, you need to take care of a few very important aspects from a legal perspective. House acceptance procedure

The mere completion of any type of construction work is not yet an indication of legal residence in a given building. For this to happen, you must go through the so-called house acceptance procedure. First, you must submit a notification of completed construction work to the appropriate architectural and construction administration body. You can make this type of notification regarding a single-family house in a simple way, you have three options: visit the appropriate office, deal with this matter by letter or electronically.

When should I submit a notice of completion of work?

It is worth mentioning that notification of completed construction work must be submitted before the building is used. After reporting this, the supervision has 14 days to file a potential objection. Only when no objection is filed can the building be used. However, the building can be used earlier, or more precisely, before the expiry of these 14 days – in this case, however, the office must issue an appropriate certificate stating that there are no grounds for filing an objection.

Is it possible to streamline the home inspection process?

The answer to this question is very simple – yes. However, you need to be well prepared for this. Unplanned activities can cause a lot of stress, which is why you should collect all important documents or certificates in one place already at the stage of construction works. It is also worth having a so-called construction journal at hand – it describes all subsequent stages of construction of your residential building. Such thorough preparation and arrangement of individual documents will certainly allow you to go through the entire process efficiently and without exposing yourself to unnecessary stress or delays.

Documents needed to formally close the construction of a single-family house

As previously emphasized, organizing important documentation in one place will speed up and streamline the process of accepting a single-family residential building. Now comes the next question, what documents will you need? Documents that should be kept include contracts with utility suppliers, protocols confirming the tightness of various types of installations, and partial acceptances of individual parts of the construction. Mandatory documents that you will need to accept the house include:

• construction log (in the case of a single-family house, it does not need to be attached to the notification of completion of construction – art. 57 sec. 1a of the Construction Law),
• technical design,
• a statement from the construction manager that the building was built in accordance with the art of construction and design requirements, that the construction site has been brought to the proper condition and that measurements of the usable area have been taken,
• geodetic documentation,
• a report on the gas system tightness testing,
• a statement of no objection from the State Fire Service and the Sanitary Inspectorate (if the design was agreed in this respect),
• as-built documentation (a copy of the approved design with changes made that occurred during construction).

Using a facility without notifying about completed work – is it possible?

Using a residential building without a prior notification of completion of construction work and “tacit consent” is illegal. What’s more, it may result in a penalty. What kind? The building supervision authority may impose a fine on you, which is calculated as follows: it is the product of the tenfold increased fee rate (s = PLN 500), the construction category coefficient (k) and the construction size coefficient (w). Both the category of objects and the aforementioned size coefficient can be easily found in the annex to the Construction Law.

Costs associated with collecting the house

The costs associated with the collection of a single-family home are reduced to official fees. The collection of a home is an expense of around PLN 1500-2500 and mainly concerns the power of attorney, as well as obtaining individual, required documents.
