Subject and rules
- The use of the www.mabudo.com website requires devices that allow access to Internet resources, an e-mail mailbox, and a web browser enabling the display of web pages.
- The subject of an order (Product) on the website is a complete set of design documentation for a standard house built in MABUDO technology – a Design available in the Mabudo House Catalogue, containing the design of a single-family residential building in 4 paper copies – 3 copies of the architectural-construction design and 1 copy of the technical design – consisting of: an architectural-construction design, a structural design, a design of internal, sanitary installations (water supply and sewerage, central heating, mechanical ventilation with heat recovery), a design of electrical, telecommunication and lightning-protection installations, and an energy performance certificate of the building.
- Purchase of the Design includes the right to use it for only one construction project, after the design has been adapted to local conditions and regulations by an authorised designer, in accordance with the attached Adaptation Standard. In particular, the Design must be supplemented by the Customer with a site development design and adapted in accordance with the local ground conditions specified in a geotechnical opinion prepared by a person with appropriate qualifications in geotechnics. The structural design, including the foundations, is prepared by Mabudo's Design Department on the basis of the geotechnical opinion, in accordance with the Adaptation Standard. The Customer may commission an authorised designer of their own to adapt the foundation design.
- The Designer chosen by the Customer to adapt the Design and prepare the site development plan is treated as the designer of the given building, who, within the meaning of Art. 20 of the Construction Law Act of 7 July 1994, assumes responsibility for the design and all the obligations and rights arising from the Act.
- The Design is a work within the meaning of the Polish Act of 4 February 1994 on Copyright and Related Rights, and the author's economic rights to the Design belong to the Seller. Purchasing the Design does not transfer those rights to the Customer. Upon delivery of the Design, the Customer receives a non-exclusive licence, unlimited in time, to use the Design for the construction of one building on one plot, within the following fields of use: (a) adaptation of the Design by the Adapting Designer within the scope set out in the Adaptation Standard, (b) reproduction of the Design in the number of copies needed to obtain a building permit or make a construction notification and to carry out the construction of that building, (c) use of the Design in administrative proceedings and during the construction of that building. The licence does not cover the construction of further buildings based on the Design, making the Design available, selling or otherwise distributing it to third parties, or changes going beyond the Adaptation Standard – such use requires separate written consent of the Seller and, as regards changes, also of the authors of the Design. The Customer may not transfer the licence to a third party without the Seller's consent.

What Mabudo does
The Adaptation Standard concerns standard designs from the catalogue of single-family residential buildings (www.mabudo.com). The Design is protected under the Polish Act of 4 February 1994 on Copyright and Related Rights. Reproduction or use of the Design in whole or in part beyond the scope of the licence described in §1 of the Terms and Conditions without the written consent of the author is prohibited.
Mabudo S.A. is a company engaged in the design, production and assembly of prefabricated elements (foundations, walls and roof trusses) of buildings, in particular single-family houses. In order to minimise the involvement of Investors in the construction process, we also carry out finishing works in houses up to developer's finish standard, i.e. including the routing of all installations within the building.
The standard designs offered by Mabudo are adapted to our prefabrication technology, and their adaptation requires particular care on the part of the Adapting Designers compared to most standard designs available on the construction market. A detailed and diligent adaptation makes it possible to avoid additional approvals at the execution stage, thereby shortening the time needed to construct the building.
General information – changes to the design
Introducing changes to a standard design is possible within the scope specified by Mabudo. A standard consent to changes is attached to the purchased design, covering the following scope:
- adapting the foundations to the geotechnical conditions at the building's location,
- changing the roof covering to one other than that designed,
- changing the location of internal doorways (while maintaining the load-bearing capacity of the building's structural elements),
- changing the execution of internal sanitary and electrical installations in accordance with the obtained conditions for the supply of utilities to the residential building,
- changing the colour scheme of the façade and roof covering, and the form of ground-level terraces,
- removing chimneys in the event of forgoing a fireplace,
- adding surface-mounted roller shutters or blinds.
Changes to the design are made by the Customer's Adapting Designer, who will prepare the site development design. Other changes not covered by the standard consent require separate written consent from the authors of the design. To obtain additional consent for changes, please contact your Customer Advisor.
Contents of the standard design
Architectural-construction design. The design consists of a descriptive part containing information on functional-utility, environmental and technical parameters, as well as building-installation equipment. The design also includes an analysis of alternative energy and heat supply systems. The drawing part consists of plans, sections, elevation views, and a schedule of window joinery. The design is prepared in three copies, which are subject to adaptation by an authorised Adapting Designer.
Technical design. The design consists of three separate trade-specific parts: structural, sanitary installations, and electrical installations, each prepared in one copy. Each of the trade-specific designs consists of a technical description, the necessary calculations, and drawings prepared on the basis of the standard architectural-construction solutions (without adaptation changes).
- Structural design – the technical description includes assumptions regarding standard soil and water conditions, which must each time be adjusted to the actual conditions specified in the geotechnical opinion. The design describes the structural-material solutions, as well as calculations taking into account typical loads. The structural design is not subject to adaptation, as it is prepared each time by Mabudo's Design Department taking into account the adaptation changes and local conditions. The foundations may be an exception – at the Customer's request, they may be adapted by an authorised designer chosen by the Customer. Before construction works begin, the design is delivered to the construction site via the Investor.
- Sanitary installations design – contains technical and installation solutions for central heating, mechanical ventilation, storm water drainage, and the water supply and sewerage installation. The design is subject to adaptation by an authorised Adapting Designer, taking into account the adaptation changes and the conditions of the plot's utility connections.
- Electrical installations design – contains technical and installation solutions for the photovoltaic installation, the lightning-protection installation, and the building's internal installations. The design is subject to adaptation by an authorised Adapting Designer, taking into account the adaptation changes and the conditions of the plot's utility connections.
Adaptation of the standard design
When purchasing a standard design, you should be aware that this design must be adapted to local conditions by an Adapting Designer chosen by the Customer. Adaptation of the standard design involves additional costs and is necessary to obtain a building permit. Adaptation of a Mabudo standard design consists of:
- preparing the site development design,
- preparing the adaptation of the architectural-construction design,
- preparing the adaptation of the technical design with regard to sanitary and electrical installations,
- compiling the attachments to the building design.
The Adapting Designer is obliged to prepare the design documentation in accordance with the Construction Law, in particular in accordance with Art. 20(1), pursuant to which the designer's basic obligations include, among others: preparing the building design in accordance with the requirements of the Act, the provisions of administrative decisions, regulations and the principles of technical knowledge; ensuring the participation of persons holding the relevant construction qualifications; mutual technical coordination of the design works; preparing information on health and safety; determining the building's area of impact; obtaining the required opinions, approvals and checks; clarifying doubts concerning the design; and exercising author's supervision at the request of the investor or the administrative authority.
Taking the above into account, the Adapting Designer's obligations include:
- adapting the standard design to local conditions: a decision on development conditions or a local zoning plan, siting conditions, ground and water conditions, and the plot's utility infrastructure,
- adapting the documentation to the requirements regarding the scope and form of the building design,
- making changes to the standard design by marking them permanently, in red, on the graphic technique used on the original design, or in the form of alternative drawings bearing a signature, a stamp with the qualification number, and a date. Alternative drawings may only be used in conjunction with the original design.
- obtaining consent to introduce changes beyond the scope of the standard consent to changes attached to the standard design, and promptly reporting any doubts concerning the design documentation to Mabudo,
- completing the title block on all drawings and the declaration, and providing them with a signature, a stamp with the construction qualification number, and a date,
- attaching the decision granting construction qualifications to the Adapting Designer and a current certificate of membership of the Chamber of Architects or the Chamber of Civil Engineers,
- attaching a declaration of the building design's compliance with applicable regulations and the principles of technical knowledge, as well as other documents required by the authority and applicable regulations,
- commissioning a geotechnical soil survey and submitting the documentation for the purpose of verifying the soil's bearing capacity and issuing an opinion on the method of foundation by Mabudo's Design Department. The client provides the scanned documents to the Customer Advisor.
Architectural-construction design – changes covered by the standard consent
- Adapting the design to local conditions (a decision on development conditions or a local zoning plan, site development, and environmental decisions). A preliminary check is carried out by Mabudo's Customer Service Department. The Investor is informed of any necessary modifications before purchasing the standard design. In case of doubt, please contact your Customer Advisor.
- Changing the roof covering to one other than that designed – permitted provided the maximum planned load on the roof slope is not exceeded. Missing information should be completed in the legend on the elevation drawing, and an appropriate note added if necessary.
- Changing the location of internal doorways, the layout of partition walls, and the purpose of rooms – elements being removed should be crossed out, planned elements drawn in, and dimensioned. Changes may not interfere with the internal structural layout, in particular the layout of columns and steel beams. A change to the location of partition walls with a steel diagonal brace is only possible after consultation with Mabudo's Design Department. Changes marked on the architectural design must be consistent with the adaptation of the sanitary and electrical installation designs.
- Changing the colour scheme of the façade – missing information should be completed in the legend on the elevation drawing.
- Changing the form of ground-level terraces – by crossing out elements being removed, drawing in planned elements, and dimensioning them; the final form should also be reflected in the site development plan. Standard window sills are not provided for terrace doors/windows in the terrace area. Where a fireplace has an air-supply duct, attention should be paid to the location of the air intake.
- Removing or adding a fireplace – when removing a chimney, cross it out on all drawings together with the air-supply duct; when adding one, mark it on each drawing together with dimensioning and the elevation of the chimney's top level, so that it does not collide with the layout of the roof trusses and the steel structure.
- Marking the ± 0.00 level of the building – the building's "zero" level (the level of the finished ground-floor floor, in metres above sea level) is necessary for correctly locating the building; it should be completed on the standard design drawings and in the site development plan.
- Marking north – draw in an arrow indicating north in accordance with the site development plan, at least on the floor plans.
- Adding surface-mounted roller shutters or blinds – mark by drawing in the dimensions of the shutter boxes on the elevation drawings and sections; interference with structural elements (window lintels) is not permitted.
Architectural-construction design – changes possible only with Mabudo's consent
Changes affecting the building's structure, and in particular interfering with the prefabricated elements, absolutely require the consent of Mabudo, preceded by a thorough analysis carried out by Mabudo's Design Department. It is not permitted to introduce changes not listed in the standard consent to changes without prior consultation with Mabudo's Design Department.
- Changing the size and location of windows – permitted provided that only windows from Mabudo's standard Window Schedule are used. The location of windows must be confirmed due to the specific nature of the prefabricated technology; roof windows may not collide with roof-truss elements. Changes to window joinery must be reflected in the floor plans, sections, elevation views, and the window schedule.
- Changing the pitch angle of the roof slope – possible only in justified cases, within a range of no more than ±5°, after confirmation by Mabudo's Design Department; the correction must be marked on the drawings together with descriptions, dimensioning, marking of the ridge level, and a correction to the technical description.
- Adding an attic – possible in the non-usable loft space, provided there is no interference with the roof-truss structure; requires insulation of the roof slope, marking of the insulation between the trusses, determination of the location of the loft hatch, and the addition of a floor. The hatch may not collide with truss elements.
Technical design – structures and installations
Structures. Due to the specific nature of the prefabricated technology, the structural design is prepared each time by Mabudo's Design Department and is not subject to adaptation. It is prepared taking into account the adaptation changes made by the Adapting Designer on the architectural-construction, sanitary installations, and electrical installations designs. The Investor is obliged to provide the required documentation (including the geotechnical soil survey). The scope covers: soil bearing capacity and foundations, external walls, the steel post-and-beam system, the roof truss (prefabricated timber trusses – without changing the spacing or replacing them with a traditional truss), and the necessary calculations. The foundations may be an exception – the Customer may commission an authorised designer of their own to adapt them.
Sanitary installations. These cover the water supply and sanitary sewerage installation, storm water drainage, central heating, and mechanical ventilation with heat recovery. Any changes to the location of equipment and penetrations in prefabricated elements must be precisely described and dimensioned on the floor plans and isometric drawings. It is not permitted to locate large-section installations within the thermal insulation layer of Mabudo's external wall (thermal bridges). Only a fireplace with a closed combustion chamber is permitted.
Electrical installations. These cover changes to the layout of sockets and light points, changes to the number, power, or location of photovoltaic panels (taking into account the impact on the energy performance certificate), and the addition or removal of design elements. Any penetrations in prefabricated elements must be described and dimensioned.
Energy performance. Particular attention should be paid to changes in: room cubic capacity, the layers of external partitions (except for prefabricated elements, where changes are not permitted), the window openings in external walls, the building's heating and ventilation method, and the photovoltaic installation. Any change affecting the energy performance certificate requires it to be re-prepared.
Attachments to the building design
- Attaching the necessary opinions, approvals, permits and other documents required by the authority and applicable regulations, including, among others, the geotechnical soil survey, the conditions for connecting the building to the utility infrastructure, a statement from the road authority on the possibility of connecting the plot to a public road, and other documents as needed.
- Preparing health and safety information (BIOZ).
- Attaching the decision granting construction qualifications to the Adapting Designer and a current certificate of membership of the Chamber of Architects or the Chamber of Civil Engineers, for each of the adapted parts of the design.
- Attaching the Adapting Designer's declaration of the building design's compliance with applicable regulations and the principles of technical knowledge, for each of the adapted parts of the design.
Clauses and notes
- Mabudo reserves the right to refuse to introduce changes.
- Confirmation of the possibility of introducing changes does not release the designer from responsibility for the design solutions introduced. The Adapting Designer is responsible for their scope and correctness, and for compliance with the applicable standards and regulations in force on the date the design is submitted as an attachment to the building permit application.
- Before submitting the adaptation design to the authority, please send a list of the planned changes together with the design to your Customer Advisor for final verification. This is a very important step given the prefabricated nature of the construction.
- All changes to the standard design that are not listed in the standard consent to changes referred to in point 1 of the Standard Design require the mandatory written consent of Mabudo.
- Changes affecting the building's structural elements require an individual design tailored to the Investor's requirements. Design work of this kind is priced individually, each time, by Mabudo's Design Department.
- Introducing changes consisting of the addition or removal of building elements and materials included in the scope of works appropriate for a given standard may result in a change to the price of the building.
- In the event of introducing permitted changes to the design within the Plus scope, the Customer undertakes to introduce them through their Adapting Designer in accordance with this document, before obtaining the building permit.
- In the event of introducing changes to the design within the Finish scope, the Customer undertakes to introduce them through their Adapting Designer in accordance with this document and to provide the design with the changes no later than on the day of the Finish scope valuation. After signing the Finish agreement, it will not be possible to introduce changes, and the work will be carried out on the basis of Attachment 2a together with the design, in the parts (scopes) in which they overlap.
