House for registration up to 70 m² – questions and concerns of investors
Your own single-family home without complicated formalities? New regulations allow for the implementation of investments up to 70 m² only upon notification. Simplified formal procedures combined with modern prefabrication technology – this is a chance for an even more efficient investment implementation process. It is important that it is not only quick, but also safe. In this respect, the act amending the construction law – already at the design stage – aroused many emotions. Do houses with notification up to 70 m² actually involve a potential risk of a threat to the safety of construction and use of the building? What other doubts do investors have?
Building a house is a constant process of making decisions. Finding the right plot, a good design, obtaining financing, cooperation with the architect and contractors at subsequent stages of the investment implementation. It also involves design choices regarding the interior and facade – but also the appearance of the property, where the dream house will finally appear. However, before it appears, the appropriate administrative body must issue a building permit. Obtaining a permit is associated with a number of formalities, preparation and submission of appropriate documentation to the office and waiting for a final decision. In many cases, the entire procedure takes up to several months.
House for registration with a project and without a manager
From January 3, 2022, a single-family house up to 70 m² can be built without a permit – by submitting a project. You do not have to appoint a construction manager or keep a construction log. If you are the owner of the land, you can start the investment immediately after submitting a complete set of documents.
Submission with a good project
Together with the completed construction notification form, the investor is required to submit a project. A good project for a house up to 70 m² should meet your needs, but also be adapted to the plot and all the requirements for the development of construction documentation. Therefore, the typical project must be adapted by the adapting architect and it is this version of the project that should be attached to the construction notification for a house up to 70 m².
Who is responsible for the design and who is responsible for managing the construction?
At the time of adaptation, the architect takes over full responsibility for the project – all duties and authorizations. The so-called authorial supervision, which concerns the compliance of the construction works with the project, is however performed at the request of the investor. The architect who performs authorial supervision may indeed suspend the works if irregularities are noticed, but only by notifying the appropriate construction supervision body.
According to the new act, if there is no appointed construction manager or logbook, the only person who supervises the correct course of construction works is the investor. He is the one who bears full responsibility for managing the construction and at the stage of submitting the notification, he also submits an appropriate written statement.
With a manager, it’s more efficient and safer
A construction manager is a person who has construction qualifications and specialist knowledge. He organizes and manages the construction in accordance with the project and applicable regulations: technical and construction and occupational health and safety regulations. He is responsible for the course of construction works and the use of products with appropriate utility properties. If you decide to build a house up to 70 m² without a permit and without a manager, you declare in writing that you are taking responsibility for managing the construction.
Even the construction of a small residential building with a simple structure should be supervised by a qualified person – thanks to this, it will proceed smoothly and safely. Of course, if you decide to build a house for registration up to 70 m² without a manager and without a construction log, this does not have to mean lowering the safety standards of workers employed on the construction site and subsequent users, as long as you provide yourself with the support of people with appropriate qualifications.
